Project Description
PROTECTION OF RIGHTS is our mutual Project with UKRAINIAN RENAISSANCE - XXI Inerrnational Charity Foundation (Kyiv, Ukraine) for Providing Legal Assistance to Victims of Russian Aggression in Ukraine. The beneficiaries of the program are civilians, specific individuals affected by the Russian aggression.
As of August 1, 2023, direct damage caused to the civilian population by Russian aggression is estimated to range from 100 billion to 300 billion US dollars.
As of August 1, 2023 the Project has joint 23 lawyers. Additional lawyers can potentially be engaged from the Bar Association of the Kyiv Region, which accounts for nearly one-third of all lawyers in Ukraine, totaling around 12,000 lawyers.
To determine the status of a victim in a criminal case, prepare a civil lawsuit, and support the trial of such a lawsuit in the jurisdiction of Ukraine, it is necessary to expend between 65 and 125 hours of an attorney's work. The average cost of an attorney's work per hour of such qualification in Ukraine is $30 per hour. Thus, the legal support of an average case involving one victim costs approximately $3,000.
Within the framework of the Project and with the resources available to our foundation, we can provide legal assistance to 40 individuals per month. Potentially, with the involvement of additional resources, the number of individuals who can receive comprehensive legal assistance could increase to 200 people per month.
The average size of damage for individuals who have lost property due to the armed aggression of the Russian Federation is $75,000 for direct damage and $50,000 for moral damage. Estimates suggest that the number of people in need of legal assistance ranges from 3 million to 10 million individuals.
Accordingly, with proper funding for the Project to provide free legal assistance by the attorneys engaged by our foundations, it is possible to obtain judicial decisions for 1,200 individuals per year, with a total compensation of approximately $150 million, which is 1% of those affected by armed aggression.
To pay for the hours worked by attorneys at a potentially feasible service volume (1,200 affected individuals) per year, $4.2 million is required.
Given the existing potential, the annual funding capacity for attorneys' fees (23–25 lawyers) is $1,440,000, which can provide legal assistance to 480 individuals, with a likely compensation amount of around $60 million.
The cost of additional expert and appraiser services for an average individual case is $500. In Ukraine, court fees are not payable for this category of cases (it is exempt from paying court fees). Accordingly, the cost of legal support for this category of cases is 2.8% of the potential compensation amount.
The potential annual funding volume for the Project which the foundation can currently provide, is $1,680,000 for 480 civilians, with a likely compensation amount of $60,000,000.
The potential opportunities to increase the volume of legal assistance are up to 1,200 individuals per year, with a probable compensation amount of $150 million.
